How to Investigate Your PI Before Hiring
You might be suprised to discover that more than half of the private investigators listed in the Yellow Pages are not licensed. After checking the licensure status of every company and investigator listed in the 2010 - 2011 Yellow Book we discovered nearly 7 out of every 10 listings were unlicensed. In fact, several were not even legitimate companies or had been dissolved by the Secretary of State's Office.
Q: They will work for less, so why should I care?
A: Hiring an unlicensed investigator can cause you to lose in the event that the case goes to court. Under cross examination any attorney worth their retainer will ask the "expert witness" questions related to their licensure status, experience, etc. When this occurs and it is discovered that the "investigator" is unlicensed, the judge must exclude the testimony because Kentucky law specifically states that unlicensed practice is a crime (misdemeanor on the first offense, a felony on the second or subsequent). This means anything brought to court on your behalf is gone.
You get what you pay for. Any investigator that agrees to unlimited work for low wages most likely is not licensed or insured.
